Coaching Agreement

This agreement is between Sean Forster (Coach) and the Client (Named Below).

Both parties agree to the following:

COACHING PRACTICE & RELATIONSHIP:				
Coaching is a relationship between the Coach and the Client to facilitate the process of personal, professional, and/or spiritual growth and development. The Client and Coach agree that the coaching relationship will be designed together.					
Coaching is for individuals who are emotionally and psychologically well and who want to make changes and move forward in their lives. Coaching is not mentoring, advice, therapy, or counseling.		
By entering into this relationship, the Coach and Client acknowledge that the Client wants to make significant progress and/or change in his/her life and that progress and change happen at rates that are unique to each individual. 
				
COACHING SESSIONS & PROCEDURES:
All coaching sessions are 50 minutes in duration. Coaching sessions are conducted in person, by telephone, telepresence (Zoom), or by email. The Coach will contact the Client or log on at the scheduled time and it is the responsibility of the Client to be present.

Payment & Cost:
All sessions are paid for in advance by check, cash, credit card, or electronic transfer. The Client agrees to pay for up to 12 sessions in advance at $150 per session for individual or $200 per session for couples. The Client and Coach may agree to an alternate plan. Please speak to your Coach if you are experiencing financial hardship and require a payment plan to accommodate your specific needs.

Late Fee:
If the Client is more than 15 minutes late for the coaching session without communication, the Coach will assume the session is canceled and the Client will forfeit the session fee. 

Canceling and/or Rescheduling:
Canceling and/or rescheduling coaching can be provided via telephone, text message, or email. Please allow at least 48-hour notice to cancel and/or reschedule. Sessions canceled and/or rescheduled within 48 hours of the scheduled session are subject to forfeit of the session fee.

Termination of Agreement & refund policy:
All coaching sessions are pre-booked, paid for in advance, and non-refundable (should a client terminate the agreement for whatever reason). The coach reserves the right to terminate the agreement and cancel all pre-booked sessions without refund or explanation should a client manifest hostile, aggressive, inappropriate, or violent behavior. If, however, the coach should choose to refund a Client, the refund (based solely on the discretion of the coach) will be calculated on the remaining pre-booked sessions left on the Client’s worksheet. Sessions already used will not be refunded. Further, in such cancellation, the Client will also incur an additional $100.00 administration fee. All pre-booked sessions must be used within 6 months of purchase.

CONFIDENTIALITY:

The coaching relationship is built on trust. The Coach agrees to keep all information about and conversations with the Client private and confidential. No personal ideas, information, thoughts, or experiences expressed by the Client will be shared with anyone without the permission of the Client. Confidentiality is the Client’s right, regardless of who is paying the coaching fees.
 							
From time to time, the Coach may share the nature of the coaching session, without any Client identifying details, with either another coaching professional or mentor for the purpose of the Coach seeking guidance or with others for educational purposes.
					
Confidentiality exceptions include:
Information is requested through a court order or subpoena.					
If the Client is a danger to themselves or others.
When there’s more than one person present in the room listening to the coaching session with the Client’s consent.	
When the coaching session is being recorded (The Coach is required to make the Client aware if the session is being recorded).

LIABILITY AND RESPONSIBILITY:

The Coach works on the basis that the Client, is fully responsible for their own life and decisions. The Coach will offer suggestions, options, and coaching, based on life and professional experience, and will work with the Client to identify solutions to their problems, but any decision about a course of action is the Client’s, and they accept full responsibility for such decisions. The Client should carefully evaluate the consequences of various options, and decide accordingly. The Coach makes no representation or warranty to the Client that any of the coaching methods, sessions, or activities will work for their particular circumstances and in no way guarantee any results.

Agreement not to Hold Liable & Indemnity.
The Client acknowledges that the Coaching Sessions may be personally, emotionally, and physically challenging and that there may be occasions on which they will feel challenging emotions including, but not limited to, frustration, anger, grief, and stress. The Client agrees to cancel with 48 hrs notice any session in the event that you are not well enough to continue. The Client will not hold the Coach liable for any loss or cost incurred by them (including but not limited to any person related to or associated with them) in the event of mental, physical, financial, emotional stress, or distress (or other ailment or condition) caused either directly or indirectly in relation to the Coaching Sessions. The Client shall indemnify the Coach in the event of any such claim, including but not limited to any claims made against the Coach by any person related to or associated with the Client. Anything said by the Coach, verbally or in writing, shall not be constituted to be advice of any kind, including, but not limited to, medical, psychological, legal, financial, counseling, business, or actuarial advice. The Client agrees that the Coach shall not be liable to them in any way, and the Client shall indemnify and save the Coach harmless for any and all losses or costs incurred by the Client including but not limited to any other person related to them for any action or inaction taken by the Client or anyone else as a result of the Coaching Sessions or any other conversations the Client and Coach have, whether by meeting, texts, email, telephone, or otherwise. The Client represents and warrants that they are of clear mind to think and act autonomously. Further, the Client represents and warrants that they are not currently undergoing therapy of any kind, or that if they are, they have obtained the express permission of their therapist to engage in this coaching arrangement. If the Client cannot make these representations and warranties, they have an obligation to inform the Coach of any such history, or any past therapy sessions, so the Client and Coach can discuss if coaching is appropriate for the Client’s circumstances. If the Client begins therapy during coaching, they agree to immediately obtain the expressed permission in writing from the therapist to continue being coached, (a copy of the letter will be needed to be on file) or the Client will cancel all future coaching sessions. The Coach reserves the right to terminate sessions immediately, and without prior notice, if the Coach believes therapy would be more appropriate for your situation than coaching. (In such case you would receive a full refund of the un-used sessions based on the refund policy).
